These Terms of Service (the “Terms”) are a contract between you and Bite Built AI (“we,” “us,” or “our”). By creating an account or using our app or website, you agree to these Terms.
1. The Service
Bite Built AI is a mobile and web application that helps you log food, track macros, log workouts, and review nutrition and fitness trends. We add, remove, and improve features over time.
Not medical advice. The Service is for general wellness and informational purposes only. It does not diagnose, treat, or prevent any condition. Consult a qualified professional for medical, dietary, or fitness decisions, especially if you have a health condition, are pregnant, or take medication.
2. Eligibility and accounts
You must be at least 13 years old to use the Service (16 in the EU/UK). If you're under the age of majority in your region, you confirm a parent or guardian has reviewed these Terms.
You're responsible for keeping your credentials secret and for activity on your account. Notify us at support@bitebuiltai.com if you suspect unauthorized access.
3. Subscriptions and purchases
Bite Built AI offers a free tier plus paid plans and consumable scan packs. Paid offerings are sold through the Apple App Store or Google Play, which process payment and manage renewal.
What each tier includes
- Free. Workout logging.
- Plus.Everything in Free, plus full meal & macro logging and progress charts & analytics.
- Pro. Everything in Plus, plus 100 AI meal scans per month.
- Scan packs. Consumable add-ons (10, 25, or 100 scans) for users who want extra scans without upgrading.
Auto-renewing subscription terms
Plus and Pro are auto-renewable monthly subscriptions. The current prices for each tier are shown clearly inside the app and on the App Store / Google Play product listing before you confirm purchase; prices may vary by region.
- Renewal. Your subscription automatically renews at the end of each one-month period unless auto-renew is turned off at least 24 hours before the end of the current period.
- Charge timing. Your Apple ID or Google account is charged for renewal within 24 hours prior to the end of the current period at the price of the selected subscription.
- Manage or cancel. You can manage your subscription and turn off auto-renewal at any time:
- iOS: Settings → [your name] → Subscriptions
- Android: Play Store → account icon → Payments & subscriptions → Subscriptions
- Free trials. If we offer a free trial, any unused portion is forfeited when you purchase a subscription, where required by Apple or Google policy.
- Refunds. Refunds are processed by Apple and Google per their published policies. We are not able to issue refunds for App Store or Play Store charges directly, but we will help you request one if you contact support@bitebuiltai.com.
- Scan packs. Consumable scan credits are non-refundable once consumed and do not expire during active account use.
- Price changes. If we change subscription prices, we will notify you in-app or by email before the change affects you. Price changes never apply retroactively to a paid period you have already been charged for.
- Apple end-user licence. iOS users are also subject to Apple's standard licensed application end-user licence agreement in addition to these Terms.
4. Acceptable use
You agree not to:
- Reverse-engineer, scrape, or resell any part of the Service.
- Use the Service to transmit malware or spam.
- Attempt to disrupt the Service or bypass rate limits and access controls.
- Submit content that's unlawful, harassing, or infringes someone else's rights.
- Use automated systems to create accounts or submit meals at scale.
We may suspend or terminate accounts that violate these rules.
5. Your content
You own the meals, photos, and workout logs you create in the Service (“Your Content”). By using the Service, you grant us a limited license to store, process, and display Your Content as necessary to deliver the Service to you. We do not sell Your Content or use it to train external models.
6. AI outputs
Food estimates, macro calculations, and coach suggestions are generated algorithmically and may be wrong. Use judgement before acting on them, especially for medical or allergy-related decisions.
7. Intellectual property
The Service, including the name “Bite Built AI,” our logos, interface designs, copy, and code, are owned by us or our licensors and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes.
8. Third-party services
The Service integrates with Apple HealthKit, Google Health Connect, Apple App Store, Google Play, RevenueCat, and other providers. You're bound by their terms where you use them. We're not responsible for their content or acts.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR REQUIREMENTS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $100. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
11. Indemnification
You'll defend and indemnify us from third-party claims arising from Your Content or your misuse of the Service or violation of these Terms, up to the limits of applicable law.
12. Termination
You can delete your account at any time from Settings. We may terminate or suspend access if you violate these Terms. The sections that by their nature should survive termination (IP, disclaimers, limitation of liability, governing law) survive.
13. Governing law
These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Delaware, unless mandatory consumer-protection law in your home jurisdiction grants you other rights.
14. Changes to the Terms
We may update these Terms. If the changes are material, we'll notify you in-app or by email before they take effect. Continued use after changes means acceptance of the updated Terms.
